			<content:encoded><![CDATA[<p>A Dallas ISD middle school teacher has been arrested after allegations that she pawned a district owned projector three times in recent months.  Pawnshop records show that the teacher Ann Pace Demus pawned an $800 Epson projector at the EZ pawn shop in Pleasant Grove, court documents state.  Demus faces a charge of theft over $1500 by a public servent,  a state jail felony punishable by up to two years in jail and a fine not to exceed $10,000.</p>
<p>Demus, who teaches at Seagoville Middle School has not released a public comment, but did post $1500 bond on monday.</p>
<p>In late June, Dallas ISD police were searching online pawnshop records when they found the district owned projector at a pawnshop.  The pawn shop manager told Dallas ISD police that Demus had pawned the projector three times since March.</p>

			<content:encoded><![CDATA[<p>A man suspected of <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">fatally shooting</a> a woman Sunday afternoon surrendered to police officers after an hours-long standoff at an apartment building.</p>
<p>Police say Luis A. Perez, 23, of Alvarado went to his ex-girlfriend’s apartment in the 1600 block of South Oak Street about 3 p.m. and <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">shot her mother </a>during an <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">altercation</a> outside the building. The mother died at a hospital.</p>
<p>According to the Tarrant County Medical Examiner’s website, the victim’s name was Maria Ramirez, 57.</p>
<p>Police say that Perez had a history of <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">domestic violence</a>, and that his ex-girlfriend, with whom he had children, also had a <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">protective order</a> against him.</p>
<p>Perez fled the scene, police say, but was reported through a 911 call to be at the Brandon Oaks Apartments in the 2800 block of East Park Row Drive several hours later.</p>
<p>“When I came home [about 4 or 5 p.m.], I saw cops lined up,” said Rico McCants, who lives in the complex. “They just kept coming and coming.”</p>
<p>Officers evacuated neighbors from several units during the standoff, at one point carrying a woman and her two small children across the courtyard to safety.</p>
<p>By sundown, SWAT officers and armored vehicles were swarming around the apartment building, with a sniper on the roof of a mini-mall next door.</p>
<p>Just after 9 p.m., Alvaredo surrendered peacefully. An officer screamed, “get your hands up!” and a few minutes later a police car pulled out of the complex with a man handcuffed in the back seat.</p>

			<content:encoded><![CDATA[<p>A Dallas police officer faces <a href="http://www.criminal-defense-dallas.us">criminal charges </a>after being accused of assaulting his girlfriend and preventing her from calling 911.</p>
<p>Senior Cpl. James Andrews, 31, faces one count of misdemeanor assault and interference with making an emergency call. Both are punishable by up to a year in jail.</p>
<p>He has been released from the Dallas County Jail on bail totaling $2,500.</p>
<p>Police responded to a report of a domestic disturbance at the couple’s home in the 13300 block of Maham Road about 3 p.m. Wednesday.</p>
<p>The woman told police that she and Andrews were arguing about money, according to an arrest report. She said he pinned her on a bed, preventing her from getting up, so she bit him on a finger in self-defense.</p>
<p>She said he then pinned her against a wall, so she scratched him. He pushed her, causing her to fall down, the report states.</p>
<p>As she tried to dial 911, she said, he grabbed her phone and smashed it against a mantel. She left the apartment and went to a neighbor’s apartment and called 911. The arrest report describes her as having minor bruising on her arms.</p>
<p>Andrews joined the Dallas Police Department in 1997.</p>

			<content:encoded><![CDATA[<p>A Dallas police officer with a troubled disciplinary history was arrested Wednesday and accused of<a href="http://www.criminal-defense-dallas.us"> stealing </a>a gun from a motorist, authorities say.</p>
<p>Officer Lavar Horne faces a charge of theft by a public servant and tampering with evidence. Both are <a href="http://www.criminal-defense-dallas.us">third degree felonies </a>punishable by up to 10 years in prison and a $10,000 fine.</p>
<p>Police Chief David Brown fired Horne and two other officers Wednesday during disciplinary hearings. One officer fought with a hospital employee and wrote about it on Facebook, and the other fought with the owner and a bouncer at a Greenville bar, police officials said.</p>
<p>With these firings, 24 officers have been terminated through the department’s internal affairs disciplinary process since Brown assumed command of the department more than a year ago.</p>
<p>Brown did not respond to a request for comment. Horne’s attorney declined to comment.</p>
<p>Authorities say Horne conducted a traffic stop on April 28 during which he searched a vehicle and seized a handgun and <a href="http://www.criminal-defense-dallas.us">marijuana</a>. He allowed the occupants of the vehicle to leave without arresting them.</p>
<p>Horne, who was assigned to northeast patrol at the time, did not take the gun and the marijuana to the property room at the end of his shift as required, police officials said. Later, a man in the vehicle contacted a supervisor at Horne’s patrol station and told them that Horne had taken the gun.</p>
<p>Horne told the supervisor that he didn’t have the gun but later told police commanders that he had forgotten he had it in his bag. He told investigators that he threw the marijuana away, police said.</p>
<p>Investigators also found that he turned off his digital video recorder during the traffic stop. They also discovered that he had turned off his in car computer and didn’t notify police dispatchers that he’d stopped a vehicle.</p>
<p>Horne, who grew up in South Dallas, was featured in November 2003 in The Dallas Morning News in a series of stories about the department’s questionable hiring practices.</p>
<p>The department rejected Horne the first time he applied in 2001. He failed the civil service exam. A three officer screening board deemed him “unable to logically process information,” according to department records.</p>
<p>He reapplied, and the department hired him in December 2002. He was fired in October 2003 after the department discovered his license had been suspended for eight months for not having auto insurance. As a probationary officer, he had no right of appeal.</p>
<p>In January 2004, then interim Police Chief Randy Hampton reinstated Horne after he told Hampton that he had never received notice that his license had been suspended. He also showed Hampton evidence that he had always had insurance.</p>
<p>“Some people had been saying I was a bad officer, and I’m going to prove them wrong. I’m going to go back and do my job,” Horne told The News at the time.</p>
<p>Between 2005 and 2007, Horne was disciplined three times for missing court. In December 2008, he received a 20 day suspension after internal investigators said he had had turned in fake doctor’s notes.</p>
<p>When confronted, Horne admitted they were fake and said he made a mistake because he panicked.</p>
<p>“I apologize to the department … for my conduct in making a very bad decision,” Horne wrote to police investigators. “I can promise and assure you this will not happen again.”</p>
<p>Around that same time, Horne also fell under scrutiny after vice detectives believed he had tipped off club employees about an impending raid. Horne denied having tipped anybody off and said he was not aware of the upcoming raid. Internal affairs investigators ultimately couldn’t prove that Horne had tipped anybody off.</p>
<p>Also fired Wednesday&#8230;</p>
<p>Sgt. Hector Roa, once a rising star in the department, was fired over an off-duty February 2010 incident in which authorities say he fought with and pulled a gun on a Greenville Avenue bar owner and bouncer in a drunken rage as they tried to get him to leave at closing time. Roa faces two counts of aggravated assault in connection with the bar incident but he has not been indicted, highly unusual given how long ago the incident occurred. Roa told investigators that he was acting in self defense.</p>
<p>Also cited in his firing was an incident that occurred in September 2010 where he hit a parked car in the parking garage of his apartment complex. Roa told investigators that he accidentally hit the parked car and placed a business card on the vehicle. No card was found. When police supervisors arrived at Roa’s apartment, they found him <a href="http://www.criminal-defense-dallas.us">intoxicated</a>. Roa was on administrative leave for the February incident at the time, and since the accident occurred during what would have been his duty hours, he was found to be drunk on duty. Roa denied being intoxicated when he hit the parked car.</p>
<p>Senior Cpl. Cat Lafitte was fired after internal investigators found she escalated a February disturbance and posted comments on Facebook that could put the Police Department in a bad light.</p>
<p>She is now facing a<a href="http://www.criminal-defense-dallas.us"> misdemeanor assault charge </a>over the incident, in which she was accused of attacking a hospital employee with a boot at a Plano hospital. Lafitte told investigators that she acted in self defense when the employee tried to put her in a headlock and slammed her to the ground. Lafitte bragged about the incident on Facebook, noting that she “took this (expletive) to school.”</p>
<p>She later told investigators that she made these comments during a medical crisis and said, “There is nothing offensive or inflammatory about them unless they are taken out of context.”</p>
<p>Internal investigators also found that Lafitte was absent without leave for a week in May and that she violated the department’s sick leave policy.</p>

			<content:encoded><![CDATA[<p>A drunken driving suspect was arrested after a <a href="http://www.criminal-defense-dallas.us">man on a moped was struck and killed</a> on a street in Uptown.</p>
<p>Tim William Parks, 54, of Dallas faces a charge of <a href="http://www.criminal-defense-dallas.us">intoxication manslaughter </a>and is being held in the Dallas County Jail.</p>
<p>Parks was driving a Mercedes-Benz sedan the wrong way on southbound Cole Avenue shortly after 11 p.m. When he struck the man&#8217;s Honda scooter near Fitzhugh Avenue, police said.</p>
<p>The victim, a 35 year old Dallas man, was taken to Baylor University Medical Center where he died. His name was not released pending notification of his family.</p>
<p>A passenger in the Mercedes said he tried to warn Parks but it was too late to stop.</p>
<p>Police said Parks appeared to be <a href="http://www.criminal-defense-dallas.us">under the influence of alcohol or drugs</a>.</p>

			<content:encoded><![CDATA[<p>The Dallas County district attorney’s office is asking that a man who pleaded guilty in 1997 to sexually assaulting a teenage girl be declared innocent of the crime, the man’s attorney said Monday.</p>
<p>Hilliard Fields pleaded guilty to the <a href="http://www.criminal-defense-dallas.us">sexual assault </a>and a drug charge in exchange for two five year sentences to be served concurrently. But evidence now shows that he did not commit the sex crime, said his attorney, Gary Udashen.</p>
<p>“He pled to it, and that was a mistake,” Udashen said. “He thought it wasn’t going to affect him.”</p>
<p>Fields, 39, has been out of prison for nine years but has had to register as a sex offender. If the Texas Court of Criminal Appeals agrees that Fields is innocent, he will no longer be considered a <a href="http://www.criminal-defense-dallas.us">sex offender </a>and will not be required to register.</p>
<p>“That’s his benefit,” Udashen said.</p>
<p>Udashen said that Fields will not be eligible for compensation for his time behind bars on the sex crime conviction because he was serving the same amount of time for the drug conviction.</p>
<p>Udashen said Fields is not challenging that conviction, for possession of a controlled substance with the intent to deliver.</p>
<p>Fields declined to comment through Udashen.</p>
<p>There is no DNA evidence in the case, but the girl’s mother has admitted she lied when she claimed her daughter was having sex with Fields, Udashen said. The girl, who Udashen says was 13 or 14 at the time of the allegation, always denied any sexual contact.</p>
<p>The statute of limitations has expired for prosecuting anyone for perjury.</p>
<p>The identities of the girl and her mother were not disclosed.</p>
<p>Initially, the girl’s mother told authorities she saw a diary entry by her daughter that mentioned the sexual relationship. But Udashen said she could never provide the diary.</p>
<p>Udashen said a friend of the girl’s mother had been in a relationship with Fields and was angry with him. Udashen said the friend convinced the girl’s mother to tell authorities that Fields had sex with her daughter.</p>
<p>When asked for comment about Fields’ case, Jamille Bradfield, the spokeswoman for Dallas County District Attorney Craig Watkins, said, “I’ll check and get back to you.” She did not provide any additional information.</p>

			<content:encoded><![CDATA[<p>An Irving man has been charged with murder in the <a href="http://www.criminal-defense-dallas.us">beating death </a>of a woman found Tuesday in her apartment.</p>
<p>Kevin Monroe Amos, 41, was arrested Wednesday night after he called police to tell them that he had information about Pamela Joann Wilson’s death.</p>
<p>Officers detained Amos on an outstanding aggravated robbery warrant, then charged him with murder after further investigation.</p>
<p>He was in custody at Irving City Jail.</p>
<p>Wilson, 46, was found dead with blunt force trauma to the head about 10:30 p.m. Tuesday at the Summergate Apartments in the 3800 block of North Belt Line Road, police said.</p>
<p>Her husband told police he found her there after being unable to contact her.</p>
<p>The couple had recently separated.</p>

			<content:encoded><![CDATA[<p>A Dallas County jury will return to the courthouse Thursday to determine the fate of a man accused of intentionally and knowingly killing a Dallas police officer.</p>
<p>They deliberated about 31/2 hours Wednesday before state District Judge Rick Magnis sequestered them for the night.</p>
<p>If jurors convict Charles Payne of <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">capital murder </a>for killing Senior Cpl. Norm Smith, prosecutors will ask that he get the death penalty.</p>
<p>Prosecutors Pat Kirlin and David Alex told jurors during closing arguments that Payne, 29, knew Smith was a police officer when he fired through the door in January 2009 at an east Oak Cliff apartment complex.</p>
<p>To convict Payne of <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">capital murder</a>, jurors must believe Payne knew that the men outside his door were police officers when he fired the shots.</p>
<p>“All the credible evidence in the case proves that he did,” Alex told jurors. Kirlin told jurors that Payne “saw three uniformed Dallas police officers that night” before firing any shots.</p>
<p>But defense attorney Ed “Bubba” King and Dallas County public defenders Michelle Moore and Matthew Seymour say Payne believed he was being robbed. They say he acted in <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">self-defense</a>.</p>
<p>“He didn’t know it was the police,” King said in closing arguments. “He didn’t intentionally take the life of Norm Smith. He didn’t knowingly take the life of Norm Smith.”</p>
<p>If jurors find Payne not guilty of <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">capital murder</a>, they could also find him guilty of lesser charges ranging from <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">murder</a> to <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">manslaughter</a> to <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">criminally negligent homicide</a>.</p>
<p>Or they could find him not guilty.</p>
<p>Police went to the apartment that evening to serve a Tarrant County <a title="Dallas Criminal Defense Attorney" href="http://www.criminal-defense-dallas.us/index.html">aggravated robbery</a> warrant on Payne’s cousin.</p>
<p>When the gang unit officers went to the door, Payne asked who was there. Smith used a fake name as a ruse to get someone inside to open the door.</p>
<p>Payne partially opened the door and started to shut it when Smith tried to prevent him from shutting it. Payne then fired four shots through the door, striking Smith once near the left eye.</p>
<p>Payne testified during the trial that he thought he was being robbed and feared for his life.</p>
<p>Smith died almost instantly.</p>
<p>Officers dragged Smith away from the door and fired back at Payne, who fired an additional shot at police.</p>
<p>Before adjourning for the evening, jurors asked to examine the door and were brought into the courtroom to view it. No one was allowed in the courtroom with the jurors.</p>
<p>Kirlin, in closing arguments, called Smith “the heart and soul” of the Dallas Police Department’s gang unit and asked jurors to send a message to the police department that jurors will stand up for them.</p>
<p>At the end of his remarks, Kirlin silently held a large picture of Smith in front of the jury.</p>
<p>King told jurors that the prosecutor’s case and the fact that they are seeking the death penalty is based on pressure from Dallas police, mentioning that Smith’s widow, Regina Smith, is a lieutenant at the department.</p>
<p>“This isn’t a memorial, it’s a courthouse,” King said in closing arguments. “You don’t come down here to memorialize someone … you come down here to find out what’s the truth.”</p>
