Ex Officer To Plead Guiity In Theft Charge

A narcotics investigator is accused of pocketing $2,000 in a FBI sting.  The former top narcotics investigator for the Mesquite Police Department will plead guilty Tuesday to federal theft charges after he pocketed $2,000 of what he thought was drug money in an FBI sting.  John David Mcallister could receive up to 10 years in prison on a charge of stealing government money.  A sentence date has not been set. 

Mcallister, a 21 year police veteran who spent the last five  years as a sergeant over the narcotics unit, resigned from the department on March 3, the day he was arrested.  The department is reviewing cases in which he played a role in.  FBI agents got a tip in December that Mcallister had been stealing money during searches.  Undercover agents installed  cameras in a vehicle and planted $100,000 in it.  On march 1st, they asked Mcallister to help them impound it in the parking lot of a grocery store on Modley Drive, telling him the owner was suspected drug dealer.

Some Favor Easing Home Search rules

Police officers who smell marijuana coming from an apartment can break down the door and burst in if they have reason to believe the evidence might be destroyed, several Supreme court Justices suggested Wednesday. In the pst, the high court has said police usually cannot enter a home or apartment without a search warrant because of the fourth amendment’s ban on unreasonable searches and seizures.

But the court’s conservatives said during arguments in a drug case that they favored relaxing that rule when police say they have urgent need to act. Since the war on drugs began in the 1980′s the supreme court has steadily given police more leeway to search cars, travelers and bagggage. But the justices have been reluctant to allow searches of homes without a warrant.
